Your privacy is important to CocuSocial LLC. (“CocuSocial” or “we” or “our” or “us”). This Privacy Policy (“Policy”) sets forth the privacy policies that apply to your use of www.cocusocial.com (the “Site”) and any services or products and any related software applications (collectively, the “Service”) offered and/or operated by CocuSocial. This Policy describes the information practices for the Site and Service, including what type of information is gathered and tracked, how the information is used, and with whom the information is shared.
By accessing the Site or using the Service, or by otherwise providing us with your personal information, you are accepting the practices and policies described in this Policy. PLEASE REVIEW THIS POLICY AND THE TERMS OF USE FOR THIS SITE AND/OR SERVICE CAREFULLY. YOUR USE OF THE SITE AND/OR SERVICE SIGNIFIES YOUR AGREEMENT TO SUCH POLICY AND TERMS OF USE.
Personal Information That May Be Collected
When you sign up for or use the Site or Service, we may request a user to provide certain personal information, which may include: first and last name, postal address, e-mail address, user name, password, telephone number, credit/debit card number and expiration date (or other payment-method information) and other information about a specific individual that identifies the individual (“Personal Information”).
CocuSocial may take photographs or videos at CocuSocial events. CocuSocial may publish photographs or videos which contain your voice and/or likeness, and CocuSocial may use such photographs or videos, or any portion thereof, for advertising, marketing, publicity and promotional activities on its Site, social networking sites or third party websites such as Groupon who are promoting CocuSocial’s products. You may request that any photographs or videos containing your likeness or voice be deleted by contacting us at hello@cocusocial.com.
Uses Made of the Information
(a) Limited Uses Identified. CocuSocial uses your Personal Information to deliver the Services to you. For example, CocuSocial uses Personal Information to reply to inquiries, handle complaints, to notify you of changes to the event for which you registered and to request your participation in surveys. We may also use Personal Information for the internal operational and administrative purposes of the Service. We may enter Personal Information into our contact management database, and may use such database to send you marketing materials and to contact you regarding your interest in other CocuSocial products and services.
(b) Aggregate Information. We will also create statistical, aggregated data relating to our users and the Service for analytical purposes. Aggregated data is derived from Personal Information but in its aggregated form it does not relate to or identify any particular customer or individual or any specific user’s data. This data is used to understand our customer base and to develop, improve and market our services.
(c) Online Advertising. Some companies that help CocuSocial deliver interactive on-line advertising, such as banner ads, may collect and use information about our customers to help us better understand the types of advertising or promotions that are most appealing to our customers. After it is collected the information is aggregated so it is not identifiable to a specific individual.
How Can You Opt Out of Use and Disclosure of Your Information?
If you would like your Personal Information removed from our mailing list or database, please contact us at info@cocusocial.com. In the event of any such removal, CocuSocial may retain copies of information for its archives.
Access and Updating of Information
If you would like to delete, correct or update any of your Personal Information that we may be storing, you may submit a request to us by sending an email to info@cocusocial.com. Your email should include adequate details of your request.
Security
We use reasonable security precautions to protect the security and integrity of your Personal Information in accordance with this Policy and applicable law. However, no Internet transmission is completely secure, and we cannot guarantee that security breaches will not occur. Without limitation of the foregoing, we are not responsible for the actions of hackers and other unauthorized third parties that breach our reasonable security procedures.
Third Party Links
The Site may contain links to other websites. CocuSocial is not responsible for the privacy practices or the content of those websites. Users should be aware of this when they leave the Site and review the privacy statements of each website they visit that collects personal information. This Policy applies solely to Personal Information collected by CocuSocial.
Your California Privacy Rights (California Residents)
On September 27, 2013, California enacted A.B. 370, amending the California Online Privacy Protection Act to require website operators like us to disclose how we respond to “Do Not Track Signals”; and whether third parties collect personally identifiable information about users when they visit us.
(1) We do not track our customers over time and across third party websites to provide targeted advertising and therefore we do not monitor, recognize, or honor any opt-out or do not track mechanisms, including general web browser “Do Not Track” settings and/or signals.
(2) We do not authorize the collection of personally identifiable information from our users for third party use through advertising technologies without separate user consent. California Civil Code Section 1798.83 also permits our customers who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please send an email to info@cocusocial.com. Please note that we are only required to respond to one request per customer each year.
Disclosure of the Information
(a) CocuSocial’s Disclosure of Personal Information: CocuSocial will not disclose Personal Information to any third party except to our third party service providers that we engage to provide services to us (“Contractors”) who are bound by written obligations of confidentiality, or as described under “Permitted Disclosures” below.
(b) Social Media Plug-Ins and Sharing with Other Sites You May Authorize. Social media plug-ins of social networks, which may include but are not limited to Facebook, Twitter, Tumblr and Pinterest, may be integrated into our Site and Service. Where our Site or Service contains a plug-in to a social networking site, these are clearly marked (i.e. with a button). If you choose to click on one of these buttons or links, your browser will connect directly to the servers of the relevant social networking site. The social media network directly transmits the content of the plug-in to your browser. CocuSocial assumes no responsibility or liability for the actions of such third parties with respect to their use of your information or otherwise. Accordingly, make sure you are aware of and comfortable with the privacy policies of any third parties that you authorize to gather information from CocuSocial.
(c) Web Tracking Information: We disclose information obtained through the tracking technologies described below to Contractors, in order to analyze the performance of the Service and the behavior of users, and to operate and improve the Service.
(d) Aggregate Information: We may disclose aggregated data that does not contain Personal Information that identifies any particular user or person to any third parties, such as potential customers, business partners, advertisers, and funding sources, in order to describe our business and operations.
(e) Permitted Disclosures: Notwithstanding the foregoing, CocuSocial reserves the right to disclose any information we collect in connection with the Service, without further notice to you (a) to any successor to CocuSocial’s business as a result of any merger, acquisition or similar transaction; and (b) to any law enforcement or regulatory authority to the extent required by law or if, in our reasonable discretion, disclosure is necessary to investigate fraud or any threat to the safety of any individual, to protect CocuSocial’s legal rights or to protect the rights of third parties.
Use of Computer Tracking Technologies
(a) No Tracking of Personal Information. The Site is not set up to track, collect or distribute Personal Information not entered by visitors. Through web site access logs CocuSocial does collect clickstream data and HTTP protocol elements, which generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff for research and development, user analysis and business decision making, all of which improve our Service. The statistics garnered, which contain no Personal Information and cannot be used to gather such information, may also be provided to third parties.
(b) Use of Cookies. CocuSocial, or our Contractors, collects non-identifiable and personal information through the use of various technologies, including “cookies”. A cookie is an alphanumeric identifier that a Web site can transfer to customer’s hard drive through customer’s browser. The cookie is then stored on customer’s computer as an anonymous tag that identifies the customer’s computer, but not the customer. Cookies may be sent by CocuSocial or its Contractors. Customer can set its browser to notify customer before a cookie is received, giving an opportunity to decide whether to accept the cookie. Customer may also set its browser to turn off cookies; however, some Web sites may not then work properly.
(c) Use of Web Beacon Technologies. CocuSocial may also use Web beacon or other technologies to better tailor the Site to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the Site, a non-identifiable notice of that visit is generated which may be processed by CocuSocial or by its Contractors. Web beacons usually work in conjunction with cookies. If customer does not want cookie information to be associated with customer’s visits to these pages, customer can set its browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.
(d) Collection of Non-Identifiable Information. CocuSocial may collect non-identifiable information from user visits to the Site in order to provide better customer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on the Site; Web site and system administration; user analysis; and business decision making. Such information is sometimes known as “clickstream data.” CocuSocial or its Contractors may use this data to analyze trends and statistics.
(e) Collection of Personal Information. CocuSocial collects Personal Information from customer during a transaction. CocuSocial may extract some Personal Information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help CocuSocial understand trends and patterns. This information is not reviewed at an individual level.
Guidelines Regarding Children
CocuSocial is not designed or intended for use by persons under 21. At various places on the Site or Service, we may ask users for their age. Persons under 21 are expressly prohibited from submitting any Personal Information to us, and if we discover that we have inadvertently gathered any such information from a person under 21, we will take appropriate steps to delete it.
Changes to this Privacy Policy
CocuSocial may modify or amend this Policy from time to time. You can determine when this Policy was last revised by referring to the “Last Updated” legend at the top of this page. Any changes to this Policy will become effective upon posting of the revised Policy on the Site. By continuing to use the Site or Service following such changes, you will be deemed to have agreed to such changes. If you do not agree with the terms of this Policy, as they may be modified from time to time, please do not continue using the Site or Service.
Applicable Law
CocuSocial and its servers are located in the United States and are subject to the applicable state and federal laws of the United States. If you choose to access the Site and/or Service, you consent to the use and disclosure of information in accordance with this Policy and subject to such laws.
Terms of Use
This Policy forms part of, and is subject to, the provisions of CocuSocial’s Terms of Use.
